If so, of course, that evidence of the Bank people would not go to strengthen the Plaintiff's case. But apart from any other consideration before the court could be asked to appoint a commission to take evidence in Chicago, it would be necessary to name or indicate at least one witness whose evidence is required.

It does not appear that Matthew Saylor Falconer kept accounts of the manner in which he distributed the assets of Matthew Falconer's Estate, of which from his point of view, he and his mother, were the sole beneficiaries. Both mother and son appear to have died before 1890, the son in September 1888.
